The Digital Private Property Clause
Digital Private Property & Right of Entry
1. The Physical Reality of the NetherLand
This website, its databases, and all digital assets served from this domain are the products of private labor and are hosted on physical hardware located within my physical private property. Unlike cloud-hosted services that exist in anonymous data centers, the “NetherLand” is a direct extension of my personal residence and private library.
2. The “Open Door” Analogy
The Public IP address and Domain Name associated with this server function exactly like a physical street address.
- The Invitation: Your ability to access this content is not an inherent right of the public domain, but a conditional invitation. By making this site accessible, I have “opened the door” to my private library.
- The Act of Reading: When you access a post or an article, you are—in a very literal sense—reading a book from a shelf in my living room. You are a guest in a private space.
3. Terms of Residency
Because this is a private residence:
Data as Personal Property: All data generated by this server, including logs, meta-data, and intellectual content, is considered private property. Your presence here implies an agreement to respect the boundaries of this private digital estate.
Revocation of Access: I reserve the right to “close the door” (block access via IP, firewall, or other means) to any individual or entity at any time, for any reason, just as any homeowner may ask a guest to leave their property.
The “Good Faith” Rule: As a guest in my private library, you are expected to act in good faith. Any attempt to exploit, bypass, or ‘climb through the windows’ of the server’s security architecture is considered a violation of private property boundaries and will result in a permanent ban.
Prohibition of Automated Harvesters: Just as one would not bring a high-speed photocopier into a private home to copy every book on the shelves, the use of automated scrapers, AI training bots, or data-harvesting scripts is strictly prohibited without explicit written permission.
Guest Responsibility & Liability: While I strive to keep my ‘home’ safe for visitors, you enter the NetherLand at your own risk. I am not liable for any digital ‘trips or falls’ (data loss, software conflicts, or external links) that may occur during your visit.
The “Quiet Hours” Clause: I reserve the right to perform ‘maintenance’ on my property at any time. The site may be taken offline for repairs, updates, or simply to ‘turn off the lights’ for the night.
